The framework's core objective is to assert "federal preemption," effectively blocking disparate and restrictive state-level AI laws to solidify America's innovative edge in the global AI race.
Ending the "50 Different Rules" Problem
The administration argues that the current landscape of state-by-state regulation is creating a fragmented system of "50 conflicting sets of rules," which stifles innovation and burdens businesses with excessive compliance costs. The new framework explicitly calls for federal law to take precedence over state AI regulations. It proposes prohibiting states from interfering with the fundamental development of AI and shields developers from liability for the misuse of their models by third parties.
Six Pillars: Balancing Innovation with Responsibility
The framework outlines a comprehensive strategy across six key areas:
Protecting Children & Empowering Parents: Mandates robust age-verification mechanisms for AI platforms and equips parents with powerful tools to manage their children's privacy, screen time, and content exposure to mitigate risks of exploitation and self-harm.
Strengthening Communities & Energy Dominance: Ensures that residential electricity users do not bear the cost of new AI data centers. It also calls for streamlining permitting processes to allow data centers to generate their own power, thereby enhancing grid reliability.
Respecting IP & Supporting Creators: Seeks to protect the intellectual property of creators while acknowledging AI's need to learn from publicly available information. The framework suggests a licensing framework allowing rights holders to collectively negotiate compensation with AI providers.
Preventing Censorship & Protecting Free Speech: Reaffirms the commitment to the First Amendment, preventing AI systems from being weaponized to suppress legitimate political expression or dissent.
Promoting Innovation & Ensuring U.S. Leadership: Rejects the creation of new federal AI regulatory bodies, favoring oversight through existing sector-specific agencies and industry-led standards. It also proposes "regulatory sandboxes" to accelerate AI deployment.
Educating & Cultivating an AI-Ready Workforce: Encourages Congress to advance workforce development and training programs, ensuring American workers share in the economic growth driven by AI.
